{"id":419,"date":"2026-03-30T13:28:23","date_gmt":"2026-03-30T13:28:23","guid":{"rendered":"https:\/\/deuxchemins.be\/terms-and-conditions\/"},"modified":"2026-04-20T09:54:11","modified_gmt":"2026-04-20T09:54:11","slug":"terms-and-conditions","status":"publish","type":"page","link":"https:\/\/deuxchemins.be\/en\/terms-and-conditions\/","title":{"rendered":"terms and conditions"},"content":{"rendered":"\t\t<div data-elementor-type=\"wp-page\" data-elementor-id=\"419\" class=\"elementor elementor-419 elementor-180\" data-elementor-post-type=\"page\">\n\t\t\t\t<div class=\"elementor-element elementor-element-5dfea14 e-flex e-con-boxed e-con e-parent\" data-id=\"5dfea14\" data-element_type=\"container\" data-e-type=\"container\" data-settings=\"{&quot;background_background&quot;:&quot;classic&quot;}\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t\t\t<div class=\"elementor-element elementor-element-21beb46 animated-slow elementor-invisible elementor-widget elementor-widget-heading\" data-id=\"21beb46\" data-element_type=\"widget\" data-e-type=\"widget\" data-settings=\"{&quot;_animation&quot;:&quot;fadeInUp&quot;}\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">terms and conditions<\/h2>\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-faaf788 e-flex e-con-boxed e-con e-parent\" data-id=\"faaf788\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t\t\t<div class=\"elementor-element elementor-element-b8f725d elementor-widget elementor-widget-text-editor\" data-id=\"b8f725d\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><strong>TERMS AND CONDITIONS \u2013 DEUXCHEMINS<\/strong><\/p><p><strong>Version 1.0<\/strong><\/p><ol><li><strong>  Definitions<\/strong><\/li><\/ol><p>In these terms and conditions, the following definitions apply:<\/p><ul><li><strong>DeuxChemins<\/strong>: the company offering tours, guided accompaniment, presentations, content creation, and related services.<\/li><li><strong>Client<\/strong>: any natural or legal person who enters into an agreement with DeuxChemins.<\/li><li><strong>Services<\/strong>: all activities offered by DeuxChemins, including but not limited to guided tours, excursions, lectures, presentations, content development, and consultancy.<\/li><li><strong>Agreement<\/strong>: any arrangement between DeuxChemins and the client regarding the provision of services.<\/li><\/ul><ol start=\"2\"><li><strong>  Applicability<\/strong><\/li><\/ol><ul><li>These terms and conditions apply to all quotes, agreements, services, and deliveries by DeuxChemins, unless otherwise agreed in writing.<\/li><li>Deviations are only valid if they have been confirmed in writing by DeuxChemins.<\/li><li>Any general terms and conditions of the client are explicitly rejected.<\/li><\/ul><ol start=\"3\"><li><strong>  Quotes and formation of the agreement<\/strong><\/li><\/ol><ul><li>All quotes from DeuxChemins are without obligation, unless stated otherwise.<\/li><li>An agreement is formed as soon as the client confirms the quote in writing, by email, or via a booking platform.<\/li><li>DeuxChemins reserves the right to refuse an assignment without stating reasons.<\/li><\/ul><ol start=\"4\"><li><strong>  Prices and payment<\/strong><\/li><\/ol><ul><li>All prices are stated in euros and exclude VAT, unless indicated otherwise.<\/li><li>Payment must be made within <strong>14 days<\/strong> of the invoice date, unless otherwise agreed.<\/li><li>In the event of late payment, the client is legally and without notice of default liable for:<ul><li>interest on arrears of <strong>1% per month<\/strong>, and<\/li><li>a fixed compensation of <strong>10%<\/strong> of the invoice amount, with a minimum of \u20ac50.<\/li><\/ul><\/li><li>DeuxChemins reserves the right to suspend services if payment is not received.<\/li><\/ul><ol start=\"5\"><li><strong>  Cancellation and modification by the client<\/strong><\/li><\/ol><ul><li>Cancellations must be made in writing.<\/li><li>The following cancellation conditions apply:<ul><li><strong>More than 14 days in advance<\/strong>: free of charge.<\/li><li><strong>14 to 7 days in advance<\/strong>: 50% of the total amount.<\/li><li><strong>Less than 7 days in advance<\/strong>: 100% of the total amount.<\/li><\/ul><\/li><li>Changes to date, time, or content are only accepted if the schedule permits. Any additional costs will be charged. <\/li><\/ul><ol start=\"6\"><li><strong>  Cancellation or modification by DeuxChemins<\/strong><\/li><\/ol><ul><li>DeuxChemins may cancel or modify a service in case of force majeure, illness, safety risks, or circumstances beyond its control.<\/li><li>In such cases, the client will be informed as soon as possible and offered an alternative date or a refund.<\/li><li>DeuxChemins is not liable for additional costs incurred by the client (such as transport, accommodation, etc.).<\/li><\/ul><ol start=\"7\"><li><strong>  Execution of services<\/strong><\/li><\/ol><ul><li>DeuxChemins performs the services to the best of its ability, with professionalism, care, and attention to historical accuracy.<\/li><li>The client provides all necessary information, access, and cooperation to ensure the services can be performed correctly.<\/li><li>Times and duration of tours are indicative; circumstances such as weather, crowds, or safety may require adjustments.<\/li><\/ul><ul><li>By booking, participants declare they understand that the tour is a <br>recreational activity and not a transport service. They agree that <br>the route, stops, and duration of the tour are determined solely by the guide. <\/li><li> <\/li><\/ul><ol start=\"8\"><li><strong>  Liability<\/strong><\/li><\/ol><ul><li>DeuxChemins is not liable for damage resulting from:<ul><li>incorrect or incomplete information provided by the client,<\/li><li>circumstances beyond the control of DeuxChemins,<\/li><li>loss, damage, or theft of personal property during tours or activities.<\/li><\/ul><\/li><li>In all cases, the liability of DeuxChemins is limited to the amount of the relevant invoice.<\/li><li>Participation in tours is always at your own risk.<\/li><\/ul><ol start=\"9\"><li><strong>  Intellectual property<\/strong><\/li><\/ol><ul><li>All texts, presentations, photos, designs, tour concepts, and other creations by DeuxChemins remain the property of DeuxChemins, unless otherwise agreed in writing.<\/li><li>It is not permitted to copy, distribute, or commercially use material from DeuxChemins without prior written permission.<\/li><\/ul><ol start=\"10\"><li><strong>  Privacy and data processing<\/strong><\/li><\/ol><ul><li>DeuxChemins processes personal data solely for the execution of the agreement and in accordance with applicable privacy legislation.<\/li><li>Data is not shared with third parties, unless necessary for the execution of the services or required by law.<\/li><\/ul><ol start=\"11\"><li><strong>  Force majeure<\/strong><\/li><\/ol><ul><li>Force majeure is defined as: any circumstance that prevents the execution of the agreement and cannot be attributed to DeuxChemins, such as extreme weather conditions, strikes, pandemics, technical failures, or government measures.<\/li><li>During force majeure, obligations are suspended. If the period lasts longer than 30 days, both parties may terminate the agreement without compensation. <\/li><\/ul><ol start=\"12\"><li><strong>  Complaints<\/strong><\/li><\/ol><ul><li>Complaints must be reported in writing within <strong>7 days<\/strong> after the service has been performed.<\/li><li>DeuxChemins will investigate the complaint carefully and respond within a reasonable period.<\/li><\/ul><ol start=\"13\"><li><strong>  Applicable law and competent court<\/strong><\/li><\/ol><ul><li>All agreements are governed by <strong>Belgian law<\/strong>.<\/li><li>Disputes will be submitted to the competent court of the district of Bruges.<\/li><\/ul><ol start=\"14\"><li><strong>  Final provisions<\/strong><\/li><\/ol><ul><li>If any provision of these terms proves to be invalid, the remaining provisions remain fully in force.<\/li><li>DeuxChemins reserves the right to change these terms.
